MELBOURNE Cup runner-up Bauer will retain his placing despite receiving shockwave treatment within a week of the race, which is against the Australian rules of racing.

Racing Victoria Limited chief steward Terry Bailey said the unique circumstances of the case meant his panel could not pursue the matter.

The English horse was treated in the Sandown quarantine centre by a RVL-appointed veterinary surgeon.

Bailey said trainer Luca Cumani was entitled to assume the vet knew the local rules.

Electro shockwave treatment is widely used around the world. It is allowed until race eve in most jurisdictions.

Bauer received the physiotherapy on the Thursday before the Melbourne Cup in which he ran a nose second to Viewed.

Thanks Morgan re your immediately above news, I think this is good news. However, I wonder whether anyone else will take legal action against Racing Victoria and whether it "opens the gate" for a legal precedent that can be used in the future.
